Welcome to Game Night (the “Service”), a real-time trivia and mini-games experience available at playmytrivia.com, operated by DECO Technology (“we,” “us,” “our”). By accessing or using the Service — as a host or as a player — you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
The Service is intended only for adults. You must be at least 18 years old to use Game Night, whether you host a game or join one as a player. Hosts are responsible for ensuring that everyone they invite to play is also 18 or older. The Service is not directed to children, and we do not knowingly permit anyone under 18 to use it.
Game Night lets a host create a session of trivia questions and optional mini-games that players join from their own devices using a game code and a display name. Players do not need an account. Hosts sign in with an account to generate content and run games.
Trivia questions, answers, and mini-game content are generated automatically by a third-party artificial-intelligence model based on topics a host enters. This content is not written, reviewed, or verified by us before it appears in a game. As a result it may be:
You use AI-generated content at your own risk. We make no representation that it is accurate or appropriate, and we are not responsible for it. Hosts choose the topics and are responsible for the content their games produce and for the audience they share it with.
If you host games, you are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
You agree not to: use the Service for any unlawful purpose; harass, abuse, or harm others; enter topics or content designed to generate hateful, sexual-exploitation, or otherwise illegal material; attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service; or use it to violate anyone’s rights. We may remove content or restrict access at our discretion.
The Service, including its software, design, and branding, is owned by us or our licensors and is protected by applicable law. These Terms do not grant you any right in our trademarks or content except to use the Service as intended.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content (including AI-generated content) will be accurate or appropriate.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service or from any content it generates. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the 12 months before the claim.
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, the topics or content you create, or your violation of these Terms or of any law or third-party right.
You may stop using the Service at any time. We may suspend or end your access at any time, with or without notice, including for violation of these Terms.
We may update these Terms from time to time. Material changes take effect when we post the updated Terms here and revise the “Last updated” date. Your continued use of the Service means you accept the updated Terms.
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there.
These Terms are the entire agreement between you and us regarding the Service and supersede any prior understanding. If any provision is found unenforceable, the rest of the Terms stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
